RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

This agreement is a legal contract between the participants of the Pass2Pass Ultra-Trail event (referred to as “Participants”) and Pass2Pass Ultra-Trail Pty Ltd (referred to as the “Organizers”). By reading or signing this agreement, Participants acknowledge and accept the following terms and conditions:

Assumption of Risk: Participants understand and acknowledge that trail running is a potentially hazardous activity that involves certain risks, including running on various terrains, natural obstacles, uneven surfaces, and unpredictable weather conditions. By participating in the Pass2Pass Ultra-Trail event, Participants voluntarily assume all such risks associated with their participation.

Health and Fitness: Participants certify that they are in good health and physically fit to participate in the Pass2Pass Ultra-Trail event. Participants have not been advised by a medical professional to refrain from participating in strenuous physical activities.

Release and Waiver of Liability: Participants release and discharge Pass2Pass Ultra-Trail Pty Ltd, Cape Nature, Limietberg Conservancy, Wild Boar Trails, and any private landowners not mentioned from any and all claims, liabilities, damages, actions, or causes of action arising out of their participation in the Pass2Pass Ultra-Trail event. Participants understand and agree that the Organizers will not be held liable, neither financially nor legally, for an injury, illness (including contracting COVID-19), loss/damage to property (including third-party claims), or any other occurrence arising from their participation in the event.

Compliance with Rules and Instructions: Participants agree to comply with all rules, regulations, and instructions provided by the Organizers before, during, and after the Pass2Pass Ultra-Trail event. Failure to comply may result in disqualification from the event and restricted access to the designated trails and properties.

Indemnity: Participants agree to indemnify and hold Pass2Pass Ultra-Trail Pty Ltd, Cape Nature, Limietberg Conservancy, Wild Boar Trails, and any private landowners not mentioned harmless against any claims, liabilities, damages, or legal actions arising from their participation in the event. Participants understand and acknowledge the potential risks involved in the trail run, including difficult terrain, sharp rocks, slippery surfaces, and other hazards.

Media Consent: Participants acknowledge that all images and footage taken by the event’s contracted photographers and film Production Company during the Pass2Pass Ultra-Trail event are the property of Pass2Pass Ultra-Trail Pty Ltd. Participants consent to being photographed, filmed, and/or interviewed by the event’s contracted Media Team. Participants understand that they have no rights to these images and/or video footage unless purchased from the event organizers.
